Medical Negligence Is a Violation of Trust

Every patient has the legal right to expect competent, careful treatment. When doctors, nurses, or hospitals make preventable errors, the results can be devastating: from permanent injury to wrongful death. In New York, victims of medical malpractice have the right to pursue justice through the courts. What Is Considered Medical Malpractice?

Medical malpractice occurs when a healthcare provider deviates from the accepted standard of care, causing harm to the patient. This can include:

  • Medication mistakes or anesthesia errors
  • Failure to monitor a patient post-op
  • Neglect in nursing homes or long-term care facilities

We work with top medical experts to prove that a provider's actions fell below the accepted medical standard.

How Long Do I Have to File a Medical Malpractice Claim in New York?

In most cases, the statute of limitations is 2 years and 6 months from the date of the malpractice or from the end of continuous treatment by the provider.

For minors, the clock may be extended. If a government facility is involved, a Notice of Claim must be filed within 90 days. Timing is critical. Don’t wait to start the process.
