JUSTICE DELAYED: “BANANA KING” THOMAS HOEY, JR. PLEADS GUILTY IN FEDERAL PROCEEDING ARISING OUT OF THE DEATH OF KIM CALO, FAMILY TO SPEAK OUT
On Thursday, August 14th, 2014, “Banana King” Thomas Hoey Jr., plead guilty to three counts of a federal indictment arising out of a January 2009 incident which left Kim Calo dead. The multitude of delays in the criminal and civil prosecution of Hoey Jr. represents something all too familiar in today’s society; wealth, power, and prestige allows wrong-doers to avoid the consequences of their illegal actions.
The news of the guilty pleas provide a small token of relief to the family of Ms. Calo and her team of wrongful death attorneys who have endured an endless stream of dilatory tactics used by Hoey Jr. to avoid justice in both the criminal and civil forums. Hoey Jr., armed with the immense fortune of his company The Long Island Banana Corp., succeeded in paying a corrupt lawyer to intimidate, threaten and convince his mistress into giving perjured testimony in a grand jury proceeding aimed at indicting him in Ms. Calo’s death.
This lawyer has been disbarred, convicted of suborning perjury and has been sentenced to four years in a federal prison. His mistress, Nicole Zokiw was found guilty of giving perjured testimony and is awaiting sentencing. Correspondingly, Hoey Jr.’s limousine driver on the night of the incident has plead guilty to his role in the cover-up following Ms. Calo’s death.
In addition to Hoey’s failed scheme to avoid criminal culpability, his team of civil lawyers have consistently sought to delay and stifle the civil proceedings with endless motion practice and appeals. Hoey Jr. admitted Thursday that his illegal drug use and partying continued even after the death of Ms. Calo making evasion of both criminal and civil justice all the more appalling.
Earlier this year, Hoey Jr. was also found guilty of assault and evidence tampering in a subsequent altercation with another mistress. Hoey Jr.’s illicit and illegal tactics in delaying ultimate justice, frustrate an already tormented and grief-stricken family
With the conclusion of the federal proceedings against Hoey Jr. and his sentencing in December 2014, the lawsuit seeking a measure of civil justice to Ms. Calos’s family may finally proceed.
How Is Our Team Helping The Family Of Ms. Calo?
In late 2009, the Law Offices of Michael S. Lamonsoff filed the suit on the behalf of Kim Calo’s estate seeking damages arising out of the wrongful death of Ms. Calo. The suit alleges, among other things, negligent interference with a third-party rescuer. Hoey’s admissions Thursday, five years after the incident, exposes his frivolity towards his civil responsibility to the family of Ms Calo.
As a result of Thomas Hoey Jr.’s subterfuge and his illegal attempts to cover up his criminal liability, civil justice to the Calo family has also been delayed by multiple judicial stays. On the heels of the Hoey Jr.’s admissions, on August 18, 2014, the Law Offices of Michael S. Lamonsoff filed an Order to Show Cause in Supreme Court, New York County seeking to vacate the stay presently in place so that civil case can finally proceed.
Family members will be available for questions on August 19th, 2014, at 2:00pm at the Law Offices of Michael S. Lamonsoff.
