Our firm represents a former New York State lifeguard who was fired after his supervisors ignored his warnings about a swim instructor who was later charged with sexually molesting a 13 year old boy. At an apparent attempt of a coverup, the State fired the lifeguard on pretextual reasons just before law enforcement investigators appeared at the pool and were able to question him. Subsequent investigation by our law firm determined that the instructor had 11 prior arrests including one for sodomy before being hired by the State to work with children at the pool. Incredibally, our office also discovered that the State does not perform a background checks prior to hiring pool employees. This revelation was widely reported in the press.
