Our firm represents the family of a child with Down’s syndrome who was assaulted by his special education teacher. As a result of the medication for his condition, the child had passed gas in the class. His teacher, pulled his pants down in front of the class and sprayed his buttocks and mouth with aerosol. The child, sustained respiratory injuries and was unable to communicate what had happened to him because of his disability. The school attempted to cover it up. The father only became aware of what happened to his son several days later when a witness confidentially told him about the assault. The teacher was ultimately arrested and criminally charged.
